Terms of Service

These Terms of Service ("Terms") govern your use of Dropcast ("Dropcast," "we," "us"). By creating an account or using the platform, you agree to these Terms. If you do not agree, do not use Dropcast.

The service

Dropcast is a text-message marketing platform for events. It lets you collect opted-in contacts, record their consent, and send them text messages about events and drops.

Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Tell us right away if you think your account has been compromised.

Acceptable use and consent

You may only message people who have given you clear permission to text them. You agree to:

  • Collect and keep proof of consent for every contact you message.
  • Honor opt-out requests, including STOP, and never message a contact who has opted out.
  • Follow all applicable laws and carrier rules, including the TCPA, CAN-SPAM, and CTIA guidelines.
  • Not send spam, illegal content, or messages about prohibited goods or services.

You are responsible for the content of the messages you send and for your relationship with your contacts.

Plans, texts, and billing

Paid plans include a set number of texts each billing period. Unused texts roll over as described on our pricing page. Overage is billed at the posted rate. Annual plans are billed once per year. Fees are non-refundable except where required by law. We may change pricing with notice.

Free trial

The free trial gives you a limited number of texts for a limited time, with no card required. We may change or end the trial at any time.

Suspension and termination

We may suspend or close your account if you break these Terms, misuse the platform, or put contacts, carriers, or Dropcast at risk. You can stop using Dropcast at any time.

Disclaimers

Dropcast is provided "as is" without warranties of any kind. We do not guarantee that messages will always be delivered or that the service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent allowed by law, Dropcast is not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid us in the three months before the claim.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the effective date at the top of the page. Continued use of Dropcast means you accept the updated Terms.
